Terms & Conditions
When you sign up for classes with Liberty Theatre Co & Liberty Studios and Liberty Theatre or private lessons, you are indicating your acceptance of these terms and conditions.

Failure to read this document does not constitute an acceptable reason for not complying.
Pricing, timetable and terms and conditions are subject to change.

The following terms and conditions apply to Liberty Theatre Co & Liberty Studios:
COMMUNICATION
Our primary method of communication is email. LIBERTY THEATRE CO & LIBERTY STUDIOS is a large and busy music school with lots of events and opportunities happening at any one time. If you neglect to read our emails, you/your child will miss out on events and opportunities.
Parents are responsible for keeping Liberty Theatre Co up to date with any changes in their contact methods.
Liberty Theatre Co makes every effort to keep families well communicated. The responsibility to read communications in full lies entirely with the recipient and Liberty Theatre Co takes no responsibility for any information missed by families.

BILLING
Classes and Private Lessons are billed at the start of term or commencement of classes should you start after term has begun. We appreciate payments to be made on time and reserve the right to charge a $25 late payment charge if your invoice remains unpaid even if partial payments have been made.

DISCONTINUATION
If you would like to cancel your lessons, please submit an email with details, and we will cancel your classes. Please note that we do not offer partial refunds, though you will retain access to your classes until the end of that term assuming full payment had already been made.
WITHDRAWING FROM YOUTH MUSICAL THEATRE OR DRAMA PROGRAMS
Our shows are restricted to a certain number of cast members. Once a show has been cast and rehearsals have begin it becomes increasingly difficult for cast members to be recast and to re-audition for roles. This can have significant implications to the integrity and quality of our productions. For this reason we may charge a $150 Exit Fee per cast member who withdraws from the program once it has begun. There will also be no refunds offered.
*Please make sure you are 110% sure you will be committed to our production before taking a spot away from someone else.
CHANGING YOUR LESSON TIME
If you would like to request a change to your lesson time, we ask that you email us with 4 weeks' notice. Changes are made subject to availability.
TRIAL LESSONS
We are happy to offer trial lessons - Students will still be charged for the single lessons - payable on attendance. Should the student decide not to continue then no further fee's are payable. Should the student wish to proceed then they will be charged for all remaining lessons for the term,.

DISCONTINATION OF GROUP LESSONS
Your enrolment will remain the same throughout the calendar year unless we are notified otherwise by you.
​
If you wish to discontinue your lessons for the following term, you are required to notify us via email at least 4 weeks prior to the first day of the new term, or full fees (based on your current enrolment) for the following term will be payable and you will be invoiced accordingly.
​
If you cease to attend without giving us any notice, you will still be invoiced as per the above paragraph. Unfortunately we cannot run a viable service where last-minute changes result in significant loss of income. It's also really sad when students and families who we have built relationships with (in many cases over a number of years) simply vanish - we always appreciate the chance to say goodbye.

LATE ARRIVALS
Unfortunately we are unable to offer an extension to your lesson time in the event of your late arrival, as this results in scheduling problems for the remainder of the day.
​
ABSENCES
We appreciate the frustration of missing out on a lesson that has been paid for, and so in our makeup policy aim to strike a balance that is fair for both students and teachers. If we have to cancel a lesson due to teacher unavailability, you will be given a makeup lesson or a credit on the following term’s invoice.
​
We offer very generous provisions for missed lessons – many music schools and other activities don’t offer makeups at all. Please be aware of the following conditions:
• Makeups for private lessons will only be given if you provide at least 24 hours’ notice (based on the start of your scheduled lesson time). If you give us less than 24 hours’ notice of an absence, you will NOT receive a makeup lesson, regardless of the circumstances. We appreciate that everyone feels that their circumstances are exceptional and that they should still receive a makeup, but without a firm policy that we enforce, we end up with chaotic teaching schedules, which impacts on our ability to provide our students with high-quality experiences.

• To notify us of an anticipated lesson absence, log into your Parent & Student Portal and click on the lesson you will miss, where you will have the option to indicate your absence. Please use this method rather than emailing or texting us.
​
• Makeup lesson credits cannot be used as monetary credits on a future term’s invoice.
​
• If a student withdraws after the start of term, no refunds will be given.
​
• Students/their parents are responsible for following up owed makeups. You will not be reminded of them.
​
• Any makeups owing must be taken within 30 days. Makeups will be automatically removed from your portal area once they expire.
​
• Makeups and credits are only available to currently enrolled students. As soon as you cease to become an enrolled student, your makeup credits expire. Credits expire once a student is no longer enrolled.​
​
• The makeup times that are in the portal are the only makeup times available. We do not offer makeups during school holidays, except where we have had to cancel lessons due to teacher absence. In order to take an owed makeup, you may need to leave school early, or miss another activity.
​
• Please don’t attend in-person lessons when unwell. Spending 30 minutes in a confined space with a coughing, sneezing student practically guarantees that a teacher will become unwell.
​
PAYMENTS
Your invoice will be sent via email prior to the end of the previous term, or during the school holidays. School terms range from 9 to 11 weeks and your invoice will be adjusted accordingly.
​
The term’s fees must be paid in full or half, on or by the first day of each term. If you choose to pay half up front, the remainder is due no later than the first day of week 5 of term. If your fees are unpaid by the first day of term, your place may be offered to someone on our waiting list.
​
Late payments compromise our ability to offer outstanding learning experiences to our students and to meet our financial obligations. We reserve the right to refer invoices that are more than 10 weeks overdue to collection agencies. We also reserve the right to exclude students from lessons, classes, workshops, concerts and other activities if accounts are not up to date.
​
Unfortunately we are unable to offer shortened terms, refunds or account credits due to conflicting events, sport, sickness, family holidays or to align with private school terms.
CODE OF CONDUCT
It is important that all students feel valued, respected and safe at LIBERTY THEATRE CO. We reserve the right to discontinue the enrolment of a student whose behaviour is disruptive or upsetting to other students or staff. Students are encouraged to be respectful to one another's personal space and mental wellbeing.
We pride ourselves on creating an nurturing, enriching and inclusive environment for all our students and families. We take an extremely dim view on any form of bullying, harassment or non-inclusive behaviour. We teach our students to lift each other up, not bring them down. Equally we expect respectful behaviour from our students and parents and we will not tolerate any form of aggressions or disrespect towards other students or teachers.
Students are expected to respect each others personal space and to not use derogatory and negative names or descriptions of people.
Students who fall out of line of our Code of Conduct will first receive a verbal Yellow Card Warning and parents will be notified of what has happened.
Further poor behaviour will lead to a formal Red Card Warning with notice that further misbehaviour will lead to expulsion from All Liberty Theatre Programs.
Expulsion has never happened at Liberty and we work hard with students to help encourage uplifting, supportive and respectful behaviour but we have a class of students to think about and we cannot allow one disruptive student to take the fun and learning away from other students who have all paid the same class fees.

YOUTH THEATRE PROGRAMS & WEEKLY CLASS EXPECTATION
Liberty expects a high standard of work ethic and discipline. All students whether involved in Group Classes or one of our Youth Theatre Projects are expected to abide by the requirements of the class. In most cases, classes require the learning of scripts, music and lyrics at home in addition to in class/rehearsal. If a student is awarded a role, they are then expected to meet the requirements of that production whether a show case piece or major production. If any participant fails to meet the requirements of the project, Liberty Theatre Co reserves the right to reassign roles to another student. This includes regular absences. 2 or more absences may result in their role being reassigned.
Our productions have a minimum work expectation that cast will work outside of rehearsals to learn their lines, go over choreography and songs. Failure to meet the minimum requirements of our production puts the quality and integrity of our shows at risk which has knock on effects to the other cast members and, from a business perspective, the income potential of that production risking future production opportunities. By enrolling or being cast in a Liberty production all cast members agree to meet the following minimum expectations:
1, Learn lines, songs and choreography by the dates outlined in the rehearsal schedule or instruction from the Director.
2. Come to rehearsals prepared and ready to work hard in a controlled and focussed manner. With pencil for notes and a strong positive attitude.
3. To not cause disruption to the flow and progress of rehearsals through distracting and disrespectful behavior's (see Code of Conduct)
Failure to meet the minimum requirement of the production may result in that cast members expulsion from the program.
In the extremely unlikely event that Liberty Theatre Co is forced to cancel a production or performance and no alternate performance date can be made, refunds will be considered on a case by case basis.
Reasons for a show to be cancelled may include:
1 - Cast illness and no replacement can be made meaning the show cannot perform.
2 - Production integrity - If the show is under rehearsed, this may be due to numerous cast absences during rehearsals or failure to meet minimum program requirements.
3 - Weather factors - floods, extreme weather etc...
4 - Emergency situations.

Privacy Policy
Personal Information Collection and Use
1. LIBERTY THEATRE CO & LIBERTY STUDIOS does not collect personally identifiable information about individuals except when such individuals specifically provide such information on a voluntary basis.
2. When you submit an information inquiry with us you will be asked to complete an online form to submit information about you to us. Such information may include
1. your name;
2. your contact details such as your telephone number, physical address and email address;
3. your date of birth
4. information that allows us to process your payment to us, such as bank account details and credit card information.
What we do with Your Personal Information
We collect, hold and use your personal information for a number of purposes, generally, we use the information that we collect to:
1. assist us in providing services to you;
2. contact you or respond to your queries;
3. send information about product launches and promotions, regular email communications or newsletters outlining news, services or events.
General uses
1. We may use the information that we collect from you to advertise our services and the Website;
2. for our internal administrative, marketing and planning requirements;
3. to compile and report statistics, with all the relevant personal and/or proprietary information de-identified prior to the completion of such statistics; and
4. for purposes that are expressly permitted under any agreement with you.
To whom will Business disclose my personal information?
1. We do not disclose contact information about you publicly or to other third parties by us unless it is authorised or required by law (or when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on us in relation to the Website) or as otherwise outlined in this policy.
2. From time to time, we will also disclose your personal information (on a confidential basis) to agents and others that we use in the ordinary operation of our business, such as account and billing, shipping and fulfillment, marketing and promotion, user experience research and surveys, website hosting and support and maintenance. We will only disclose your information to the extent required for the limited purpose of the third party providing services contracted to us so that we may service you.
3. While we store the majority of the personal information that we collect from you in Australia, we may from time to time store some of the information in a computer server located in another country. We will take such reasonable steps to ensure that the overseas recipient does not breach the Australian Privacy Principles.
Testimonials
1. We may publish customer testimonials on our website, in social media profiles, on our Youtube channel and within advertising creative material. These testimonials may contain personally identifiable information. We obtain your written consent at the time the testimonial is recorded. If you want your testimonial removed please contact us at info@libertystudios.com.au
Manner of Collection
1. We will use reasonable endeavours to only collect information directly from you. If you are disclosing details of another person (for example, where you are enquiring on their behalf), it is your sole responsibility to ensure that that person understands and consents to the collection, use and disclosure of their personal information in the manner set out in this policy.
Website User Experience Tracking
1. We may from time to time use Google Analytics Advertising products: Remarketing with Google Analytics and Google Analytics Demographics and Interest Reporting. Google Analytics collects data about our site traffic via Google Advertising cookies and anonymous identifiers. Data collected via these Google products is not linked with any personally identifiable information you submit while on our Website. If you wish to opt out of the Google Analytics data collection, you may do so on Google's website at https://tools.google.com/dlpage/gaoptout/.
2. As is true of most websites and mobile applications, we and, in some instances, our third party tracking-utility partners gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.
3. We use this information, which does not identify individual users, to analyse trends, to administer the Website, to track the effectiveness of any online advertising strategy, to track users' movements around the Website and to gather demographic information about our user base as a whole.
4. Technologies such as: cookies, beacons, tags and scripts may be used by LIBERTY THEATRE CO & LIBERTY STUDIOSS and our partners (marketing and development partners), affiliates, or analytics or service providers (online customer support provider, email marketing system). These technologies are used in analysing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.
5. We may use cookies for authentication purposes and to tailor the site to user preferences. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.
6. We may use local storage objects (LSOs) such as HTML5 to store content information and preferences.
Intellectual Property (IP)
All Programs & works produced at Liberty Theatre Co are under the Intellectual Property Banner of Liberty Theatre Co This includes All Choreography, Stage Craft, Lessons Plans & Structures & Vocal Medleys.
Social Media Features
1. The Website includes Social Media Features, such as the Facebook Like button. These features may collect your IP address, which page you are visiting on our Website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website. Your interactions with these features are governed by the privacy policy of the company providing them.
Marketing Material
1. We may use your personal information to provide you with material, promotions and communications from time to time about services and products available to you from us, or from other service providers in partnership with us, or to invite you to continue to use our services. This information will only come from us. We will not on-sell your personal information to other providers without your consent.
2. You may opt out of receiving promotional materials from us at any time by contacting us at info@libertystudios.com.au or by following the 'unsubscribe' link on the relevant promotional emails.
Protecting and Maintaining Personal Information
1. We will take all reasonable steps to protect the information we hold about you from unauthorised access, use and disclosure, however we cannot guarantee that our systems and stored data will be completely free from third party interception or are free from corruption.
Accessing Personal Information
1. It is your responsibility to advise us of any changes to your personal details to ensure we can keep our records accurate and up to date. If you wish to access the information we hold about you, please submit a request to info@libertystudios.com.au. If you believe that the personal information we hold about you is incorrect, you are entitled to request amendment of such information. If we do not agree that there are grounds for amendment, then we will add a note to the personal information stating that you disagree with it. You may also request that we delete the personal information that we hold about you. Please note that if we delete your contact information, we may not be able to provide you with the subscribed service.
2. If you request us not to use personal information in a particular manner or at all, we will adopt reasonable measures to observe your request but we may, to the extent permitted by law, still use or disclose your information if you subsequently consent to the disclosure or we believe the use or disclosure is reasonably necessary to assist a law enforcement agency or as otherwise required or authorised by law. If you know the information we hold about you is not accurate or complete, please notify us. We will respond to requests for access within 30 days.
3. We will retain your information for as long as your subscription is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
PRIVACY CONCERNS
1. If you have any concerns about how we handle your personal information or require further information, please contact the Privacy Officer at info@libertystudios.com.au. Also use this contact if you no longer consent to receiving marketing material from us, or to the posting of your personal information on the Website.
2. This document represents our policy as at August 2015. We may change this document from time to time to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a prominent notice on this Website prior to the change becoming effective. Although we intend to observe this policy at all times, it is not legally binding on us in any way. From time to time we may regard it as necessary or desirable to act outside the policy. We may do so, subject only to any statutory rights you have under the Privacy Act or other applicable legislation.
